Glad to hear you are ok.
I'm no expert, but the car's insurance ought to cover this. He was at a "bike race" and turned into you. I can see no reason why this would not be covered by his insurance.

Definitely sucks, but I guess I believe you now since there are pics.
Based on Mike's car vs bike at the Vineman 70.3 this year, here is what I know: the driver was held responsible, but only because he was charged with something (illegal uturn or crossing lanes without looking or something). Otherwise since Mike slammed into the side of the car it would have been his fault. This was a non-race vehicle, so what the race has to say will be interesting as well. Keep us posted, and good luck!
Maybe you just weren't meant to get a pro card yet (based on how your luck has been going in your drive for it) :p

WOW that sucks. But hey, at least you had a good helmet or it could have been a whole lot worse.

Glad to hear your not more jacked up, but sorry to hear that it happened at all. Hope you get this all resolved quickly and no one is a pain in the butt about covering stuff.

This may be a dumb question but I've only done up to olympic distances so I don't recall ever seeing a SAG wagon, but shouldn't they be driving behind the bikers?

I am assuming here but was this a single lane road in each direction and you crossed the double yellow to pass on his left?
if so you aren't traffic laws typically say don't cross the double yellow. also cars don't typically get passed by bike on the road and he was wrong not to put on his turn signal or check for bikes but can see how he didn't expect to see you there.glad you are not seriously injured and hope his insurance pays for the bike.

Dude! AWESOME pics! But yeah, that sucks. I would imagine this will all be covered just fine, either by the driver or the race organizer. I would imagine the RD was informed of the incident?

The frame wasn't obviously broken or the wheels completely tacoed, but my wheels can't be trued and they were both knocked out of true pretty badly and the frame has an integrated derailleur hanger that can't be fixed. I'm pretty upset.....I loved that bike. I mean, I like my car, I like my girlfriend, but I loved that bike.

I'm thinking 08 Transition with Zipp Sub-9 Disc and Zipp 1080. :D Well, I was already planning on buying the wheels for my Plasma anyway, but looks like they'll be going on a different bike now.

Ok, here is MY ignorance. The 2 IM races I did stressed that you could not pass into the left lane. Period. That would be a penalty. Are the rules different in different races? I ask not to be a smart a$$ but because I would not be looking in the left lane for a bike if I weredriving on a race course.

Dude, I hate to hear about this kind of crap. By no means do I have the perception that cyclists own the roads, but when you are in your proper place and doing what you can to obey the rules of the race (and/or the road), you've got to stand back and say, "Whiskey Tango Foxtrot, over?!"
I just found this thread, and am amazed that it happened one day before my string of mishaps, though your injuries rock compared to mine (that shoulder looks gooey). That cycling karma was on a rampage last week! And don't fret about your Pro card...what good is it going to do a nuke puke? I mean, really, who do you think you are? Andy Baldwin? lol. Seriously though, I'm glad that you're ok. Be sure to update us on what the race organizers come back with.

Yeah it's the opposite over here to what it is over there...
That sucks big time!! Over here, the membership I have with Triathlon Australia comes with insurance when you're riding your bike racing or training.. Even if you're not a member, there's an extra amount you have to pay for your race entry to get a one day licence so you're covered. Maybe your race entry has something like this?

I don't think highly of the lawsuits, but some individuals need to be held repsonsible. Sue the driver for being a 'potato head', sue the event director who is responsible for racers' right-of-way on race route...and sue the driver's mother for drug induced pregnancy. If lawsuit becomes too hasslesome, I know some Boston irish mafia [or Dixie Flag rednecks] who will hold such imbesciles responsible
I already signed away the right to sue. Too much of a hassle, anyway. Besides, I ended up with about $11k from the accident to cover medical, the bike, and "inconvenience" as the insurance company phrased it.

I can say that while I would probably never sue unless I really felt like I needed to do it to cover any expenses (I wouldn't try to make money off of an accident), "signing away the right to sue" doesn't mean that you can't. Or, a better way of saying it, just because you sign saying you won't sue doesn't mean that you can be held to that if a race director (or other person) is found grossly negligent, or just generally if you can get a judge to think that you can make a case for the lawsuit despite what you may have signed.
I have a new bike (I'll put up pics when my wheels come in next week), the scars are fading, and I'm too busy to go after some grease monkey at a bike shop who can't drive.

I immagine that Gator means that he settled the claim for the 11k. If the race was relying on the waiver, they wouldn't have given him the cash.

Can that actually happen?! Apparently, the answer is "yes". I'm posting this instead of a race report. :mad:
I was doing a Half Iron race, and because of my age started 22 minutes back from the first wave. Although I passed a few hundred people in the swim (I think I had the 2nd fastest swim out of 1000), there were still a bunch of people on the bike course before me. About 12 miles in, the majority of people were going in the 18-20 mph range, while I was doing about 26 (slight tailwind here.....I was averaging a bit slower than 24 up until this point). It was on an open course and the sag wagon was in front me going the speed of most of the rest of the racers. I checked to make sure there was no oncoming traffic, and made a wide pass on the left. Halfway through, the car turned left off the road. I went all the way out into the gravel to avoid getting hit, but he STILL didn't see me and I ended up smashing into the front fender and flipping face-first into the ground. Honestly, the guy had to have the IQ of a baked potato. For God's sake, he was part of the damn bike race and didn't think to look around for bikes! Broken nose....eight stitches....etc, etc. Oh, and my $6k tri bike was totaled, along with my glasses, $300 shoes, and $240 helmet. To add insult to injury, this was the last race I needed for my pro card.....and based on my swim and the first 30 min of my bike I was feeling REALLY good that day.
